Discussion of the principle: “Anyone who manages together must also share fairly, otherwise it cannot work together.” The 4 individual and economic freedoms: Persons, capital, goods and services are obligatory for the EU Member States to be granted by the EU constitution by means of the rules on the EU internal market. Thus, by constitutional law one operates in a common free market, partly with a common currency. A constitutionally protected legal right for EU citizens, EU regions or EU countries to a fair share, i.e. a fair and/or at least as long as possible basic needs-proof compensation, does not exist. Nevertheless, even the EU states do not have the right to actively balance their external economic balance, at least within the framework of the WTO/GATT treaties, if they are lagging behind by the common market (unfair and threatening or existence). The mobile production factors labour and capital migrate to the immobile production factor soil, more precisely to the most economically viable locations, possibly by nature or historically. This (potential) dynamic runs counter to the objective of convergence and of equal living conditions, without an active constitutional balance. This should be discussed during this event, as well as the question of whether, in the joint design of contracts, one should deal with the intention that a set of rules should come out at the end that everyone should be able to find well.
