The administartion of justice is a member state competence. Shadowy attempts by federalist institutions to enhance their influence at the expense of the sovereign member states are contrary to the letter of the EU Treaties, counter-productive and have contributed greatly to the crisis of the EU by alienating national institutions. This is especially the case for courts. Severeal members states' high courts have declared the ECJ ultra vires (acting beyond its powers). This lawlessness on the part of federalist institutions must stop with immediate effect, and we must reaffirm the principles of subsidiarity and conferral.
The administration of justice falls within the competence of the Member States, but under the EU Treaty, Member States have delegated powers to achieve their common objectives within the meaning of Article 2 of the EU Treaty. The so-called shady attempts of the (federalist) EU institutions do not increase their influence on the costs of sovereign Member States, but act as openly as possible and as close to citizens as possible. National governments are directly accountable to their people. They are closest to their people. Heaven only knows what EU institutions are accountable to. The eurocrats must follow the EU Treaties to the letter, and not meddle in competences not conferred upon them.
On the base of the treaties you remind us, national governments have the duty to respect to the letter! It means that EU law prevails over national law, if you don't accept it you are out of the Treaties! It would be better if national governments read the Treaties before signing up for the adesion! I am quite sure that Article 5 is very clear on this: "The limits of Union competences are governed by the principle of conferral. (...) Under the principle of conferral, the Union shall act ONLYwithin the limits of the competences conferred upon it by the Member States IN the Treaties..."
EU law can supercede Member State law ONLY withing the scope of the competences conferred upon it IN the EU Treaties. EU institutions including the ECJ CANNOT legislate for further competences beyond what is expilcitly specified IN the treaties. ECJ has been called out as acting ultra vires (overstepping its authority) by a number of high courts of the Member States. Correctly.
Federalist institutions must limit themselves to the competences the member states generously provided them with in the Treaties.
