Reymonta 4 in Krakow and using the "MS Teams" platform, the first debate in the "Europe for the Young" series was held. The rule of law: Poland and the European Union on a collision course? The organizer of the debate was the Foundation Institute for Strategic Studies in Krakow in cooperation with the Representation of the European Commission in Warsaw and the Institute of European Studies of the Jagiellonian University in Krakow. In addition, the debate was reported as an event of the "Conference on the Future of EU Europe", which is a series of debates, panels and discussions organized by citizens that will enable citizens from all over the European Union to share ideas and shape our common future. Persons interested in participating in the debate were obliged to register in advance at the link: https://tiny.pl/9czt6 The debate was moderated by Dr. Przemysław Tacik from the Jagiellonian University. Panelists were: prof. dr hab. Sławomir Dudzik, Jagiellonian University, dr hab. Aleksandra Kustra-Rogatka, prof. UMK, Nicolaus Copernicus University in Toruń and Dr. Paweł Filipek, University of Economics in Krakow. The event was attended by a large group of young people, mainly students and students. Debate participants had the opportunity to download and read additional materials available at the link: https://tiny.pl/9cztv During the debate, Dr. Aleksandra Kustra-Rogatka introduced a broad introduction to the topic of the debate from the perspective of the regulations of the Constitution of the Republic of Poland. She emphasized that over the last three years the importance of the subject of the Constitutional Tribunal has been increasing in the relationship between the European Union and Poland. This is a particularly important topic for Europe, as it is the first time in history that the Supreme Court of a Member State has declared a treaty law unconstitutional. Then prof. dr hab. Sławomir Dudzik focused on the genesis of the dispute between the European Commission and Poland, and presented its causes and impact on the reality in Europe. The European Union is not a state, a defense alliance, what constitutes a shield for the European Union and its citizens is a law, because the Union is a Union of laws. It is not possible for the European Union to act on the ala card principle now, because it is based on the principle of equality of states, which means that the order of the European Union enjoys the primacy of the application of law in the legal order. The European Union guarantees rights, and when the Polish authorities allow these rights to be weakened, the situation becomes very unfavorable. Dr. Paweł Filipek especially emphasized the topic related to the European Court of Human Rights. The Ombudsman, as a participant in proceedings in the Court of Justice in Luxembourg and the European Court of Human Rights in Strasbourg, has a special role in this process. Subsequently, Dr. Filipek raised the issue of reforms implemented by the ruling camp, which pose a threat to judicial independence, and subsequent projects concerning the Disciplinary Chamber and the National Council of the Judiciary in Poland. After a series of questions from the moderator to the panellists, young people, participants of the debate asked a few questions from the floor. The moderator, Dr. Przemysław Tacik summed up the debate and the most important conclusions were drawn.Related Ideas
