The establishment of effective mediation systems prior to judicial proceedings.
Rules for the establishment of mediation have been developed in most countries, but in most cases they have not been effective. It is therefore necessary to set up a prior and compulsory information system for mediation for the parties to the dispute, as well as the recognition of mandatory administrative mediation for the administration in certain cases of discretionary law, and the introduction of criminal and prison mediation in the punitive systems of the Member States, with the application of Restaurative Justice criteria.
