Matrimonial equality across the EU — What is Europe’s future?
“Marital equality across the EU — What is the future of Europe?” is one of the panels at the conference “Creating ideas for young people in the European Union” organised online on 10-11.01.2022 by students of the University of Warsaw. The panel will hold a debate and exchange of views of experts in European law on the possibility of introducing matrimonial equality across the European Union. Issues such as: “Can matrimonial equality be introduced in the EU, in accordance with the Treaties?” and “What are the alternatives to such a right that would level the rights of LGBT+ people in all EU Member States?” At the end of the panel, the possibility of asking questions to speakers is foreseen. We cordially invite you to take part in our panel!
The event will take place online on Zoom.us. The matrimonial equality panel will take place at 12:00, however, we ask you to join the conference earlier in order to avoid technical problems.
Event reportAs part of the conclusions after our conference, I provide you with a report from our panel: Regulating what marriage is outside the European Union’s competence. The legal situation is currently changing due to the forthcoming CJEU rulings, which replace the legal protection of non-hetero-normative persons, which is lacking in some Member States. This includes recognition of the principle of free movement of persons, i.e. respect for the family status of same-sex marriages throughout the EU. However, the case-law of the CJEU to date is insufficient. The solution could be to regulate this area of civil law in the Treaty, to issue a regulation by the European Commission — but such initiatives would have to be supported by the political support of most Member States. A viable way forward will be to resolve further emerging cases at the Court of Justice of the European Union.
